Several instances of voter fraud will be presented in testimony by President Donald Trump’s legal team in Nevada on Thursday, according to one of the lawyers, Jesse Binnall. 

“We are going to provide evidence of real voter fraud, thousands and thousands of instances of voter fraud in Nevada,” Binnall told Fox Business’ Maria Bartiromo on “Mornings With Maria.” “[There were] 40,000 plus people who have voted twice in the election. That is real voter fraud. We have data showing that people who were on the record as having voted by mail who didn’t even receive ballots, who said they didn’t vote.”

He added that the argument that is being presented is “pretty simple.”

“It will be that election officials in Nevada, legislators, put together an election plan that was ripe for the picking,” said Binnall. “When the election came, the fraud came.”

The instances also involved voting machines, and two whistleblowers will explain “how they logged these disks containing votes in and out magically in the middle of the night, votes appearing and disappearing from disks,” said Binnall. “Election officials did nothing in order to make sure they would secure these ballots and the votes and guard against fraud.”

The team will also present evidence that voters in Nevada were disenfranchised because “every single time there is a fraudulent vote cast, put into the system, it dilutes the vote of honest voters,” Binnall said.

One of the witnesses will be a Clark County poll worker who says she observed people near her polling location going to a Biden-Harris van and filling out dozens of ballots to be “fraudulently submitted” to affect the election, said Binnall. 

He also told Bartiromo that there have been several incidents of the team being stonewalled at “every turn” with its investigation. 

“We have a whistleblower that came forward and told us about a postal meeting where they told people to deliver ballots to undeliverable addresses,” said Binnall. “That resulted in ballots being strewn all over, littered across Las Vegas … the post office is refusing to allow those people involved in that to be deposed.”

President Donald Trump says thousands of noncitizens voted in Nevada during the presidential election.

His comments came in a Thursday morning tweet.

He wrote: “Just released data shows many tho usands of noncitizens voted in Nevada. They are totally ineligible to vote!”

 on Saturday that the state’s Department of Motor Vehicles had been registering all voters who applied for driver’s licenses.

“What you may not know, is that in Nevada, legal and illegal noncitizens can hold driver’s licenses and identification cards,” it said. “Thus, unless they do their due diligence, they are prompted to register to vote. 

“The DMV finally provided a list of green card holders and noncitizens who had obtained driver’s licenses. When we compared this detailed information against the county voter records in Nevada, we discovered that 6,260 noncitizens were registered to vote and 3,987 non-citizens had voted.”

The Trump campaign says in a new lawsuit in Nevada that there is evidence that more than 40,000 people voted twice and that there is evidence that votes had been cast in the names of dead people. 

Campaign attorney Jesse Binnall told Judge James Russell Thursday in Las Vegas that 1,506 votes came from dead people, 42,284 double ballots were cast, about 20,000 voters voted without having a Nevada mailing address, and 2,468 voters had changed their addresses to another state, reports CBS affiliate KLAS-TV in Las Vegas.  

According to results certified last week by Nevada’s Supreme Court and Gov. Steve Sisolak, Trump lost to Joe Biden in Nevada by 33,596 votes. 

The legal team said it focused on a state election law that lets mail-in ballots be sent without requests, and before the hearing on Thursday the Republican Party in Nevada posted a video on Twitter showing 20 binders it said had evidence to back their claims, reports Fox News

“We have testimony from multiple witnesses reporting that the USB drives used in the election would show that vote tallies changed overnight,” the post said. “That means in the dead of night, votes would appear or disappear on these voting machines during early voting and Election Day.”

Binnall told KLAS that during the night, there is “no good explanation” why votes reappeared, but Russell noted that there still is no way to tell who may have voted for whom based on that argument. 

He also asked how the information could change the outcome of the evidence. 

Attorney Kevin Hamilton, who represented the Democrats, said that there was no evidence beyond hearsay or speculation presented and that Clark County, Nevada, had reported no instances of voter fraud in the June primary. 

Binnall told KLAS that the election was “unfortunately stolen.”

The district court judge said he will try to make a decision in the case by Friday.

Voting Machine USB Drives Had Totals Altered Overnight, Witness in Nevada Election Contest Alleges

A witness brought forward by the Trump campaign in its election contest in Nevada alleged that the memory disks used to store vote totals from election machines during the early vote period had the vote tallies unexplainably changed overnight, according to a presentation at an evidentiary hearing in Carson City on Dec. 3.

According to Jesse Binnall, who presented the evidence on behalf of the Trump campaign, the witness, whose name is shielded by a protective order, said that the vote tallies were collected from the machine at the end of every voting day and stored on Universal Serial Bus (USB) drives overnight.

“What they would do is they would log these disks in and out. Good practice. And the disks had a serial number on them. And numerous times that disk would be logged out with one vote total on it and logged back in the next morning during the early vote period with a different number on it. Sometimes more, sometimes less,” Binnall said.

“What that means is that literally in the dead of night, votes were appearing, and books are disappearing on these machines.”

Binnall said that the USB drives were not encrypted and the voting machines were not password protected. “And they were hooked up with laptops, then where the laptops themselves could have been compromised,” he added.

The allegation about the vote total alterations was one of several Binnall presented during an evidentiary hearing, the first of its kind for the Trump legal team’s six-state post-election effort.

At the core of the election challenge in Nevada are several batches of ballots that the Trump campaign alleges were either cast, processed, or counted illegally, including roughly 40,000 voters who allegedly voted twice. The campaign is also arguing that the signatures on more than 130,000 ballots were verified solely by a machine in contravention of Nevada’s election law.

The campaign is asking the court to affirm the contest and strike the electors representing former Vice President Joe Biden, who are the defendants in the contest, from representing the state of Nevada in the Electoral College.

“Every single one of these instances that we’ve identified has resulted again in the votes of honest Nevadans being disenfranchised,” Binnall said.

“We understand that this is an unusual situation but what we can’t do is turn a blind eye to vote fraud. If we’re going to keep being the beacon of representative Democracy in the world, when it goes bad—and here it went bad—we can’t just turn a blind eye to it. That’s not what we do in America. We make it right.”

Kevin Hamilton, the attorney for the defendants, delivered a comprehensive point-by-point challenge to all of the Trump campaign’s claims. He argued that the Trump campaign didn’t name a single voter among voluminous lists of ballots that were allegedly illegally cast.

“Simply put, breathtaking relief demands breathtaking evidence but contestants stand before you with nothing of the sort,” Hamilton said.

Hamilton argued that similar legal challenges against the use of the signature-matching machine have been overruled without exception by other courts. He also targeted the credibility of Jesse Kamzol, a key witness for the defendants whose testimony features a data analysis that points to a large number of potentially illegally cast ballots.

In a rebuttal delivered at the tail end of the hearing, Binnall pointed out that the defendants didn’t question Kamzol’s analysis and instead attacked his qualifications. Kamzol served as the chief data officer for the Republican National Committee as recently as 2017.

District Judge James Russell ordered both parties to submit proposed orders to the court by 10 a.m. on Friday so he can quickly make a ruling with enough time for either party to appeal to the Nevada Supreme Court.
